Inexperienced worker inspected powerline that caused Black Saturday bushfire, court hears Emily Portelli Herald Sun March 05, 2013 7:26PM

THE damage caused by a lightning strike to the powerline that sparked a deadly Black Saturday bushfire which killed 119 people was so small it was undetectable, the Supreme Court has heard.

Jonathan Beach, QC, for electricity provider SPI Electricity, said no reasonable inspector could have noticed the microscopic damage that experts say occurred prior to the February 7, 2009 fire.

"Of course lightning is a known risk... the issue for Your Honour is whether the lightning damage on this line was detectable or not,'' Mr Beach said today during his opening argument on the second day of the Kilmore East-King Lake bushfire class action.

He said there was no rational reason why the company would have replaced the line or installed $6 vibration dampers to reduce the impact of wind on the line, which would not have made a difference during the extreme weather conditions of Black Saturday.

The putrid litigation for cash culture came to the UK from America. The single biggest cold caller no-win-no-fee legal scumbags are a company called Chameleon which is American. They're the ones that phone you and imply you have been involved in an accident claim just to see if they can get business. It's quite intimidating. For some reason trading standards does not take action against it. Probably because of the way they misuse the legal system.

You can call bull**** as much as you want. I'm already finding it hard to believe you are standing up for lawyers just because they are American. And lets not get started on the American realtors that have been decimating our property market in their reckless greed for cash.

Um, Clive my friend, we learned much of it from you guys. Our judicial system was based on the English common law, which btw, is also the case in many countries around the world. As the Brits spread their seeds around the world, they also did the same with their laws. Of course the law has evolved in the US since the ratification of the Constitution, thank God it has!!! No chance I'd trade ours for yours, with conditions like EC binding on the UK your way is much worse...
